In a filing Tuesday night to dismiss Gina Carano‘s wrongful-discharge and sex-discrimination lawsuit over being fired from The Mandalorian, the Mouse House states that the former MMA fighter lost her Star Wars series job in 2021 because her decision “to publicly trivialize the Holocaust by comparing criticism of political conservatives to the annihilation of millions of Jewish people—notably, not ‘thousands’—was the final straw for Disney.”

Seeking a June 12 hearing in federal court in downtown Los Angelese before Judge Sherilyn Peace Garnett, the Daniel Petrocelli-represented Disney insists the Elon Musk-backed action should be tossed out “on the grounds that Disney has a constitutional right not to associate its artistic expression with Carano’s speech, such that the First Amendment provides a complete defense to Carano’s claims.”

Claiming her “words were consistently twisted to demonize & dehumanize me as an alt right wing extremist” during the very public dispute three years ago, Carano took the Bob Iger-run company to court in early February to get back her high-profile Mandalorian role of Rebel ranger Cara Dune and a TIE fighter full of damages.

Nobody's charging her with a crime. She's experiencing the consequences that some people face when they exploit their high profile to publish such distasteful and deluded comments.

It's not a crime to fire someone who publicly states hurtful things about a race of people when it harms the reputation of your business either.

You can be fired for being drunk when you are not at work but recognised as an employee and therefore representing the firm your work for, whether you intended to or not. Nobody needs to defend the right to be drunk. It sucks that it costs your job. But that's simply the other shoe dropping.

I heard his job used to be a weatherman on tv somewhere, and his legacy with Disney isn't gonna be as spectacular as he'd like it to be. First the tweets about the nazis is fine. Then you are defending Carano because it was nothing to do with the nazi tweets. (Why defend her if the tweets are fine?) Then you are trying to make a distinction between the nazis when they were just rising and recently empowered when they just wanted to exterminate everyone born of a certain race, and the nazis a couple of years later when they actually started doing it. As if they were two different entities where it's OK to compare them to the first one and people aren't allowed to complain about being associated with the second one.

In California, you can't fire someone for their political beliefs; they are protected under state labor laws.

I'm wondering if they will settle out of court in Carano's favor. Disney seems to have dug themselves into a hole with their public statements. Also, the fact that Pascal made social media posts about Trump and Nazis, yet faced no repercussions, seems to complicate their position.

Anyway, I could care less what her political beliefs are, I like Gina Carano and thought her character in Mandalorian was cool.

Yes those would be the social-media posts Pascal made I was referring to that Disney didn't seem to have a problem with.

However, that article provided new information I was not previously aware of:

Gina Carano is not currently employed by Lucasfilm and there are no plans for her to be in the future,”

If this statement is accurate, it suggests she wasn't actually fired; her old contract simply expired, and Disney chose not to renew it. Not renewing a contract can be significantly different from firing someone, and it might not be protected by California labor law.

If Carano's contract just ran out and Disney opted not to renew it, their legal stance could be much stronger. They could argue that they were under no obligation to continue employment beyond the agreed terms, sidestepping any implications of firing her for potentially discriminatory reasons.

This all suggests that Carano’s case is not as strongly positioned as I initially believed it to be in my earlier post. In fact, I believe Disney's actions might even be shielded under California laws since the company could argue they were merely exercising their own rights to political speech.

What Disney did was still screwed up, and I don’t agree with writing her off the show, but I'm not sure if they legally did anything wrong.

That said, I’m obviously not a lawyer and this is just me spitballing shit I have no business talking about, and I could very well be wrong.

Gina's post was making the same point that dehumanising people and taking away their rights and freedoms, which the Nazis did to MANY people (not just Jews) starts somewhere and leads to somewhere really, really awful unless are free to people speak out and have their opinion about it.
