WB would sooner pay pennies to some unknown than draw the unnecessary celeb gossip that Fox would unlikely bring and take away from the publicity that WB's marketing dept. will undoubtedly want focused on the actors playing Batman, Alfred, Com. Gordon, and whatever villain they happen to be using. If they truly want to draw attention to whoever is playing Vicky Vale then they will just cast an actress w/ much more industry-momentum than Fox currently has

I mean, they are both very good looking and famous, but Pattison has cultivated an edgy, weird, and intense outsider persona and Megan Fox has always only ever been relevant within mainstream pop culture. It would be like oil and water, no way a blockbuster event film pair these two anytime soon
She could certainly play another character in the DC universe. She'd be right at home acting alongside The Rock or even a supporting role in Aquaman or Wonder Woman. Or some shitty Suicide Squad supporting role. But Vicky Vale or anything within the central Batman franchise will not be happening
Why does Vicky Vale need significant screen time? She doesn't need to be a major character in the film or Bat's love interest. She can simply be someone there for a few scenes and Fox is certainly able to do that. It just depends on what they want to do with the character.
