While I wouldn't want to defend Franco as there is certainly enough smoke to indicate the fire exists with this idiot... I also have to dismiss anything any actress says when they wait years after a supposed event before talking bout it. If you feel like you were assaulted to in someway wronged bring it up when it happens where all parties can get witnesses and have a realistic chance of proving or disproving the allegations... but waiting 3 or 4 years before saying anything is just complete bullshit. Frankly the statute of limitation for sexual assault needs to be modified, with a requirement that anyone victimized has to come forward within 24 hours of the time it happened or that they are physically able to or they are forever barred from doing anything. Someone that is really raped isn't going to wait 4 or 5 years to go to the cops, only someone that just wants attention is going to pull that kind of shit.
share24 hours seems much too short a time limit given that some victims will have been traumatized but a agree with you that allegations made years later are unfair to the accused.
shareIf they are traumatized it doesn't stop them from call 911. If you allow more than 24 hours you are not only opening the door to the regretted sex being turned into sex, but you are also throwing away the ability to collect DNA sample to use as evidence. Rape is traumatic but it rarely leaves the victim comatose. In the rare instance where that is the case then clearly the person wasn't physically able to report what happened until they come round again.
shareProblem is in the vast majority of cases it's not about rape anyway. I mean real rape where a guy forcefully puts his shlong inside somebody. It's mostly about "inappropriate behavior" which can basically be anything.

If a woman goes to the hospital and a rape kit is done, then it become pretty clear if she was raped unless the rapist went to the trouble of wearing a condom which does happen but is in an extremely small number of cases and usually is done by serial rapist that have pre-planned what they are going to do. In most instances the rapes are either date rapes or a rape of convenience where the rapist just takes advantage of an opportunity they see.
Now the date rape is the situation that is the most difficult to prove, and sometimes it is the one where an alleged victim was not a victim at all but simply regretted hooking up with the guy. Frankly it is a good reason not to engage in sex with someone you aren't married to, or at the very least is a reason to record the act so you have evidence that you didn't rape her if she later has regrets and tried to claim you raped a willing participant.... of course with the law the it is now you would pretty much need to keep those video forever since the states are pretty much eliminating the statute of limitation on rape.
There’s no question that victims and witnesses should be encouraged to report a rape ASAP to increase the likelihood of a successful conviction — especially because physical evidence is highly perishable. I also think a statute of limitations is appropriate. I’m just not sure how long an interval is appropriate. Any cutoff would be arbitrary. I feel the right amount is probably measured in years rather than days, weeks, months or decades.
shareOnce you go beyond days you start increasing the difficulty of anyone getting evidence for or against the allegation, and that difficulty isn't going up on linearaly it is going up exponentially. You can probably tell me today where you were yesterday, probably give me a good detailed accounting by the hour... Now try to do that for a week ago... A month ago... 6 months ago... It doesn't take long until it really become impossible.
