Texas Governor Says "Black Lives DON'T matter"


"An alternate juror in the trial of a U.S. Army sergeant convicted of murder said Wednesday that Texas Gov. Greg Abbott's rush for a pardon is an “egregious overreach” to wipe aside the jury's unanimous decision over a 2020 shooting during a Black Lives Matter protest.

In an interview with The Associated Press, Jere Dowell said prosecutors put on a convincing case against Daniel Perry, who was in his car working as a ride-share driver when he shot 28-year-old Garrett Foster, who had been legally carrying an AK-47 while marching with demonstrators through downtown Austin.

As an alternate, Dowell did not have a vote in convicting Perry but said she was in the room for deliberations and she agreed with the verdict handed down Friday.

“I just think it’s a travesty,” Dowell said of Abbott already seeking a pardon.

Her comments are the first time a juror has spoken publicly since Abbott, a Republican, announced Saturday he would use the power of his office and seek to wipe away the verdict. Legal experts have called the governor’s move highly unusual and prosecutors condemned it as troubling."

When Perry was interviewed by police about what happened before the shooting and how Foster held his gun, Perry said: "I believe he was going to aim it at me … I didn’t want to give him a chance to aim at me, you know."

This is one of the more fun things about a state (by which a mean country) that allows open carry of an AK47 on a protest march where groups of people with conflicting views get together to yell at each other.

So by his own admission, the guy wasn't aiming at him. The shooter just assumed he was going to and blew him away out of fear. That statement, coupled with his social media post about wanting to kill protestors pretty much destroys the idea of this being self defense.

1) Former Austin Police Homicide Detective David Fugitt was the one to conduct the interview with Perry once he was brought to APD Headquarters. He asked Perry to demonstrate how Foster was holding his gun.

"I believe he was going to aim at me. I didn’t want to give him a chance to aim at me," Perry told Detective Fugitt in the interview.

I consider it to be self-defense. I hope the Governor can fast-track the pardon. Foster walked up to the driver's side of the car and possibly used his gun to motion for Perry to roll down his window. Other members in the crowd surrounded and hit the car so Foster was part of a dangerous mob. Texas castle doctrine includes one's car and they also have stand your ground. A person in the crowd actually shot Perry's car with three bullets after the initial shooting. Perry wouldn't know if Foster's gun was loaded or if the safety was on.

There isn't any video of the complete incident but the car did come to a stop before being surrounded by the mob. I contend that cars should be able to drive on the roads so I'm not as sympathetic about hordes of people blocking the roads.

The bottom few paragraphs from the article below describe how Foster identified himself as private security for the march and how he waved his gun barrel at another person.

This case is not about RACE. Both parties were caucasian and they were both armed. The mob surrounding Perry's car was a lynch mob and he had the right to defend himself and his car. Perry's car was surrounded by a dangerous mob that had committed acts of Burning, Looting and Murder in other cities and towns all across the nation. One of the dangerous mob members shot Perry's car THREE times.

I do not support lynch mobs and they usually exist when the police do not respond or the people do not trust the police.

I couldn't open your RL link but the link below has some of the posts. The social media posts were not presented in the trial since they are not relevant. I contend that only social media posts that specifically relate to the crime should be allowed as evidence. Perry also wrote something about driving to Dallas to shoot looters BUT that would be irrelevant since he did not drive to Dallas to shoot looters. Perry also wrote about hunting Muslims in Europe but he didn't go to Europe to hunt Muslims. People get high and post a lot of nonsense on social media and they should not be sentenced to prison over stupid social media posts.

I firmly believe the District Attorney’s. Office, acting under the authority of Jose P. Garza, tampered with me as a witness. Often witness tampering is subtle. In this case, there were foreseeable consequences if I did not comply and tailor my grand jury presentation as directed and failure to do so would adversely affect my working relationship with the District Attorney’s Office for the foreseeable future. I was afforded no choice but to comply with the directives that were issued to me by Jose Garza through his assistants.

I am familiar with the crime of witness tampering as set out in the Texas Penal Code and under the circumstances believe myself to be a victim of such tampering.

There are potentially some parallels between Rittenhouse and Foster. They both considered themselves to be acting as security. Foster was warned by the police about how he carried his rifle. I would feel threatened if a guy with a rifle approached my car. Another lady complained about a guy with an AK-47 who approached her car and bossed her around. I support Rittenhouse since there is video of him running away from the people he eventually shot.

I don't really see it. Rittenhouse was protecting property, Foster was protecting a violent mob.

Defending property is legal and moral, defending a violent mob that is attacking people, is not.

I was comparing the psychology of Foster and Rittenhouse. Both saw themselves as security/defenders and went on patrol. Foster attached himself to the BLM protest while Rittenhouse volunteered to defend the auto dealership and his town from the mob.

Rittenhouse also was walking around the town providing first aid to protestors so he deviated from his primary mission. The owners of the auto dealership also denied any involvement with Rittenhouse BUT they obviously wanted to avoid a lawsuit. There was also a curfew in effect so an argument could be made that Rittenhouse should not have been there.
