The same is said of male children with their adult female teachers. The boys wanted to have sex. But they couldn't legally consent.

I think in 1994 it would never have been an issue. Now, however? The issue of consent with a disability would have been raised.

It's not statutory rape at present. That only applies to underage persons. Of course, the SJWs are very good at getting laws changed to suit their agenda, but it would be tricky to include mental disability in a statutory rape situation. How do you measure mental incompetence accurately enough to base a law on its violation?
I'm sure there are plenty of seemingly disabled people who would welcome a bit of spontaneous sex to compensate for their sad state. Sex being such a subjective thing, who could prove that the "victim" didn't actually feel grateful for it..

But that's a very slippery slope.

I think any objective person watching the film would agree that people like Forrest deserve a sex and love life with a beautiful woman.

However, as I posted below, states like California have laws which say sex with an "incompetent" adult is rape.

Forrest wasn't smart but he wasn't mentally disabled. A mentally disabled man doesn't become a war hero the way he did (returning fire, retreating only when ordered, coming back for his squad mates).

It'd be hard to argue that a Medal of Honor winner and a biathlete with international cred is functionally retarded.

From what I can tell by googling, Gump had an intellectual disability related to low IQ. I agree with you. The guy may have been dysfunctional in general, but he could still win a Medal of Honor and he could still consent to sex.

However, there are jurisdictions in the U.S. where Jenny could have been accused of rape, and a jury would have had to decide whether Gump was able to consent.

In other words, the jury must decide whether the person had the mental faculties to give meaningful consent. Expert witnesses would generally be called at trial to offer opinions on the matter.

One could certainly question the fairness and implications of this law. Does it mean that a mentally retarded adult should be denied the chance to have a sex life because anyone having intercourse with him or her could potentially be charged with rape?

Forrest may have been slow, but he wasn't, like, straight-up retarded. Remember that he was adjudicated fit to serve in the military, and to do that certain mental competencies must be met. They don't give live ammunition and grenades to just anybody.

I was under the impression that Forrest being in the military was to show how different the requirments were back then. They were willing to ignore things like mental disabilities because they felt they needed all the men they could get. Now they are a lot more strict. For instance, my big brother years ago in the early 2000s was disqualified from joining the army just because years earlier he was prescribed an anti depressent. He didn't even take said anti depressent at that time in the 90s and wasn't taking it when be applied to the army. But that didn't matter to them. Simply being prescribed an anti depressent disqualified him.

I'm certain the requirements have changed, but they haven't changed so much that they would've given a live weapon to someone who couldn't be expected to use it responsibly.

Beyond that, we see Forrest doing a number of things in the film that demonstrate at least a baseline of intelligence, critical thinking skills, and the ability to look after himself. He was low IQ, yes, but we aren't to think of him as the sort of person who needs constant tending and care throughout his life so that he doesn't hurt himself or others. He's a successful soldier, a successful athlete, and eventually a successful businessman.

He's certainly not like the 40-year-old retarded guy with the cognitive function of a three-year-old who's sitting in the corner with his coloring book and hitting himself.

I'm not sure what the laws were surrounding the mentally challenged and their sex lives back then. I mean, this was supposed be what, the 60s when Jenny and Forrest had sex?

I would think it was probably not even on the books at that time. There was probably no law against it so... nope, not rape. lol...

In regards to my previous post about timeline, Forrest and Jenny had sex on July 4th, 1976. Great day to lose your virginity... lol.

So again, not sure what the law was back in that day but I can safely assume that it was probably against the law to have sex with the mentally impaired at that time in history but again, Forrest was not completely retarded, so, I don't think it would officially be considered rape.
