Well, from where I'm sitting and I've watched it twice believe it or not, the black guy I suppose would be charged with Manslaughter.. I don't know any other way this could go??

Sure, but you could could say the same to someone pointing a gun at you. Do we have to wait for them to shoot first?

I don't mean it that way. I'm just saying you can't wait for someone to punch you first just to hit him back. He was being pinned against the wall and the guy was raising his fist. Better you get him before he gets you.

Are you going to take the chance and throw a punch at a man who's holding a gun at you just so you can say you defended yourself?? You cannot compare the 2

My gun example was if both people had guns. If he's pointing it at you, you shoot him first.

I say no one is at fault for the actual death, but the black guy should not be found guilty of anything.

If this wasn’t filmed by a bystander the blackguy would be in custody. Good for him.

The white guy was bigger, holding him up against a post, and he feinted like he was going to swing. So the black guy swinging first could be argued as self defense. It's reasonable that he felt threatened in that situation, and acted to defend himself.

However he did swing on someone right next to the train tracks while a train was coming, so I can see him being charged for manslaughter. I can also hear someone saying "your going in" in the audio. I can't tell who it is, but if it's the black guy, it has to be a murder charge, because that would show it was intentional.

If the big white guy was the aggressor that led them to be clinched in the first place, there is zero chance the smaller black guy gets charged with anything in a place like Philadelphia. Zero chance

It’s a real video. A guy gets punched and falls on the train tracks seconds before a train get there. You don’t actually see anything though.

That's tough. I mean it I can't see a charge above Manslaughter, but I think it would be difficult to get a jury to convict after watching the video so I don't know if I think he would even be charged.
