Involved in car accident no insurance... Texas.


I'm curious...

This happened in the state of Texas.

I have an employee... her sister was involved in a car accident (it's her fault).

She does not have insurance of any kind.

This past week she received a letter in which she's been asked to pay $3,400 from the accident.

She called the people who sent her the letter (I don't know if it was the insurance company of the car she hit or a lawyer) and said she was NOT going to pay (crazy, I know).

I know she has a bank account (but I doubt she has anywhere close to that amount of money saved).

I have been reading that she can't go to jail.

But what could actually happen to her?

Her credit will go down?

Can her bank account and future paychecks be garnished?

Best advice is DO NOT TALK, text, mail anything to injured party, injured party's insurance or lawyer.

Second-best advice is DON'T PAY ANYONE ANYTHING without a written settlement agreement. A lawyer in Los Angeles might charge $500 for that, I'm guessing Texas is lower.

$3,400 sounds like small potatoes. Car accident damages and injuries in California are many multiples of that.

How serious was the accident, what damage was to injured's car, what damage was to sister's car?

No insurance and refusing to pay for something that was her fault? She sounds like a prime, A-1 scumbag.

I hope she loses her license and has her wages garnished (if she has a job).

That's what I read, that you can get your license suspended and a couple of fines... but what about the damages she was responsible for?

She can most definitely be sued.

I would recommend trying to set up a payment plan, so she doesn't have to pay it all at once. Let them know you are willing to work with them. Ignoring the problem will just make things worse.

Otherwise, two things could happen, they could sue her, or more likely, bring her to small claims court, which will end up costing a lot more with the lawyer fees and lost time being away from work. They could also make her pay for the lawyer fees of the victim.

There's no way getting around this if the driver is at fault.

Wait, she doesn't have car insurance? Is that legal in Texas?

It is not, you need at least liability insurance which the cheapest I've seen is around $30 a month.

This girl sounds like she's in big trouble then.

She'll be personally sued by the other person's insurance company and face penalties (possibly including loss of drivers license and other fines) by the Texas DMV.

were the police involved? this is a $5000.00 fine in ontario and possible license suspension.
