Another Innocent Black Man Found Guilty


People are always quick to accuse a black man of criminality when they are innocent. Like the innocent Central Park teenagers and the innocent men accused of killing Malcolm X who went to prison for years. And scores of other innocent black men who are released after decades in prison once it's discovered they didn't do the crime.

There's nothing in the indictment pointing to any evidence of his guilt. Two homophobic brothers assaulted him and lied when they were caught to save themselves. Smollet's arrest and verdict were racially motivated.

"The Evidence Provided by Matias Reyes

37. In early February of 2002, the District Attorney's Office was notified that an inmate had come forward with a claim that he had attacked and raped the Central Park jogger, and that he had committed the crime alone.

38. Reyes, now 31, is serving sentences totaling thirty- three and one-third years to life imprisonment for three rape/robberies, one rape/murder, and one robbery* that he committed between June 11 and August 5, 1989.

39. On May 8, 2002, the District Attorney's Office was notified that Reyes' DNA matched the DNA taken from the sock that had been found at the Central Park crime scene.

42. That investigation has led to the conclusion that Reyes' account of the attack and rape is corroborated by, consistent
with, or explanatory of objective, independent evidence in a number of important respects. Further, investigators have been unable to find any evidence that, as of 1989, Reyes knew or associated with the defendants or any of the individuals known to have been in the park with them on the night of April 19.

43. Reyes states that his decision to come forward with his confession was prompted by a chance encounter with Kharey Wise in Auburn Correctional Facility, and the resultant realization that Wise was still incarcerated in connection with the attack on the Central Park jogger.

WHEREFORE, for the reasons stated, the People consent to the relief requested and recommend that the Court vacate the defendants' convictions in their entirety.

I don't have to dumbass. The Chicago police department and prosecutor's office did that and obtained a conviction in court. The proof beyond reasonable doubt standard has been met. How about you present evidence that the conviction was unjust?

I can objectively provide proof with links. You're only have personal insults. Your racism is showing. If you believe he's guilty, then provide concrete evidence which I have asked for a few years.

Keelai, how do you rationalize the following?

1. Going out at 2:00 am for a subway sandwich when the temperature is -15’.
Not driving mind you, but walking.

2. After a black, gay man is viciously attacked by two racist and homophobic individuals who after verbally assaulting him, physically beat him, then pour bleach on him and then tighten a noose around his neck, this “victim,” of such a traumatizing event makes sure to collect his sandwich to take home with him. I’m not sure if you’ve ever experienced a fight or flight response in your life but I assure from personal experience, your vision as well as cognitive process narrows, as if you’re seeing the world through a peep hole.
This is a normal process which occurs so as to limit distractions and to focus instincts to one end, survival. So, that being said, why does he take the sandwich home with him?

3. As a black, gay man, who has a noose tied around his neck, why would he leave it on?
I know the reason he said but do you actually buy that?
The black community has been very clear and vocal about this, the noose would have been removed the moment it was able to be taken off, for the obvious reasons, ones that I shouldn’t have to detail to you or anyone for that matter.

4. Jussie knew the Osendaro brothers well, extremely well, even if they attacked him without Jussie’s knowledge, Jussie claims they spoke to him, shouted at him, got up close and personal with him, they wrestled, fought…., are you telling us that you honestly believe that Jussie wouldn’t recognize their shape, size, smell, sound of voice…., these guys are from Nigeria and have a vocal pattern which could simply not be missed or not identified by a close friend or relative. Imagine your intimate partner dressed in a costume and walking by you in the mall and saying your name, followed by more dialogue, are you saying you wouldn’t recognize their voice and speech pattern?

1a. The Subway restaurant was open at 2:00 a.m. because people go there to eat at that time. Smollet said he was hungry.

1b. I don't believe the temperature was that cold. I attempted to find the temperature that night online, but couldn't. I studied how Justin and the brothers were dressed that night. Smollet is wearing a sweater jacket which is too light for extreme temperature. The brothers wore jackets and were outside from at least 12am when a witness spotted them (walking her dog) to at least 2am around the time of the attack. Nobody is standing around in that cold weather for that amount of time! If it was planned, they would've arranged a shorter wait time, too. -15 is likely "windchill" nonsense.

In last link, both witnesses described the attacker(s) as white like Smollet did.

2. Subway sandwich plastic bags have a hole in which I place my wrist so I can keep both hands in my pockets especially if it's cold. If I were attacked, the bag would likely stay attached around my wrist especially if it had twisted around several times and tightened around my wrist. Several times on my way home, I have to unswing the bag for that reason. I wouldn't leave my personal things behind. I don't know Smollet's reason, but that's mine.

3. Same reason that Rev. Jessie Jackson wore a shirt covered with Dr. King's blood all day. Show his trauma. I buy it because of Jackson's behavior. "The black community" has been very vocal? Says who? The "white community"? Smollet didn't want to call the cops. His manager did.

4. The Osundairo brothers didn't want to be recognized by him. Disguise their voices. Smollet said he thought they were white because the skin near the eyes was light. They likely wore makeup. It was dark. He was attacked which is traumatic so not thinking clearly. Maybe also attacked from behind?

I still have reasonable doubt. The main problem is believing the brothers. They have reason to lie and the whole case is based on their testimony.

I never heard of Smollet before this case start. The problem is that I don't believe the two brothers. I wouldn't base my case on the word of two attackers who were caught red-handed buying evidence, walking around their victim's apartment building and texting disparaging remarks about the victim. They're not credible to me. They had plenty of time to make up a story once they knew the police had the store video.

I have reasonable doubt.
