Uh sorry but DC does not have a monopoly on super powers. If it was that easy than literally any work of fiction that had elves and dragons in it could be plagiarized from Tolkien. Do you understand how stupid that would be? Did marvel copy superman when they have wolverine super human healing abilities? Ir when they gave the hulk super strength? Or when they gave cyclops lazer eyes?

The question is about ALL the powers being EXACTLY the same, along with a similar origin story.

No. It's not a strawman. Who decides how many powers he can have before it becomes illegal?

There's no monopoly on origin stories either. Batman lost his parents, superman lost his planet, the punisher lost his family...now what? Do we not make anymore stories involving loss?

The crow and spawn both revolved around their protagonists losing their wives. Who's plagiarizing who? Spawn, the darkness, and venom all share the same symbioting shapeshifting power, who's plagiarizing who?

If you want to go down this road there's no limit to plagiarism.

For more context a judge found that Captain Marvel was an illegal copy of Superman, Fawcett Comics eventually folded and DC took over the character. Compared to this those characters are nothing alike.

Bottom line: Could DC sue? Of course; anyone can sue anyone for anything. Does it make sense to sue? Assuredly not. Would they win? Highly unlikely. . .but we live in strange times.
The Captain Marvel lawsuit happened when Superman had JUST come out, and was a new and exciting concept. These days, the landscape is much more cluttered. . .and clearly, Brightburn is INTENDED to be a riff on the original story. So it'd be a hard pull, to try and convince a judge/jury.

This is produced by James Gunn who is also directing DC's Suicide Squad sequel. Evidently he made sure they were okay with it.

Same reason they can't sue Marvel for Hyperion. there are plenty of characters with Superman's powerset.

If anyone should sue it should be the writers of the comic Irredeemable
