For all the burglaries they've committed I think they've gotten approximately 10 years in prison.
shareIt would depend. If they both had previous crimes on their record it would be more than that. I had a guy rob my apartment once. The police caught him and the judge gave him 5 years. He had also been on probation for another crime though.
shareProbably 15 - 20 years with the possibility of parole, depending on what other criminal convictions they have on their record. Since the three-strikes law didn't come into play until 1994, it wouldn't have been as bad for them at the time.
Seeing as how they escaped from prison (still laughable), that's probably another 5 years or so. Harry definitely would have received a life sentence for pointing a loaded weapon at Kevin, and threatening to murder a minor in cold blood. This is one of the reasons why I don't like the sequel.
And to think, at the end of the second installment, Harry and Marv would have had to continue serving out their sentences in Chicago, and again with charges arising from New York. Since NY is a lot more stricter than Illinois, I think the both of them would have had life without parole. Since they crossed state lines, federal charges would have been tacked on. The judge would have thrown the book at them.
If we're ignoring "Home Alone 2: Lost in New York" (1992), then yeah, what I originally stated in the first paragraph above sounds about right. They did break and enter into the McCallister's home several times (along with the neighbors), and also physically assaulted Kevin. They caused a bunch of unnecessary damages, even attempting to bite off Kevin's fingers. I don't think that would have flown over too well with a judge and jury, assuming they didn't take the prosecutor's deal.
Regardless, I still watch the first installment every year around the holidays. I tend to skip the sequel since it's completely beyond the realm of two jailbirds running into Kevin in a completely different location in a crowded city.
Yeah. There would be more charges against them in the 2nd. Though what them threatening Kevin in the first isn't reported from what we see.

Ha, I know the original is also a bit of a stretch, but even then it was just two random thieves looking to commit burglary around the holidays in a suburban area.
The only real thing I liked about the sequel was Duncan's Toy Chest, Duncan himself, and the bird lady. Other than that, pretty much what I mentioned above.
No way in hell Kevin's parents would have forgotten him AGAIN, let alone having a kid board a flight without confirming the ticket and that the alleged father was actually related to Kevin. The hotel staff was way too incompetent to let the activities that happened in the movie take place. Surely the NYPD Swat team would have evacuated the hotel if some lunatic with a gun started opening fire, even if it was from a movie on television.
It's just too ridiculous to even wrap my head around the sequel. I loved it as a kid, but never quite understood it upon repeat viewings as an adult.

In Illinois, residential burglary, which is entering a place of residence to another without consent intending to steal, leads to 4 to 15 years in prison. Since they committed numerous burglaries besides Kevin's house, they could technically face those years for each house they hit. And since they hit so many houses, a judge wouldn't be likely to go lightly on them. My guess is they'd get the full 15 years, and if they're lucky they'd serve each sentence concurrently, or at the same time. If you bring Kevin into the mix, the prison time goes up. It's not clear if he ever testifies or the police even know about everything that happened though. If they did, you bring up endangering the welfare of a child charge. They'd probably get a felony charge since they were trying to hurt Kevin and purposely put him in danger, so that could be up to 10 more years. Since we don't know if Kevin's family ever found out about anything though or if Kevin talked to the police, I'd say they got 15 years in prison.
With the second movie, it goes way up. By escaping prison, they'd get at least another 10 years. If they injured any guards or anyone else, that goes up. Then you have burglary of the toy store, which because Harry had a gun on him probably gets them charged in the first degree, which can have a sentence of up to 25 years. But my guess would be 15 years since they didn't hurt anyone while committing the burglary. Then you top if off with attempted murder of the pigeon lady, which in NY is often life with the possibility of parole. Again I'm not counting Kevin because he doesn't stick around to talk to the police. So after the second movie, they'd have to serve 45 years, then start the life sentence, and they'd have to serve 25 years before parole possibility. Bottom line, they're never getting out, they're in prison for life.
If I remember correctly these guys had a reputation for having done so many crimes over the years so that combined with what happened throughout the movie would probably send them away for life something like 30 years. They had a gun so attempted murder is definitely there.

shareI think his reasoning for not calling the police was because when he ran out of the store with the toothbrush and ran from the police, he thought he was a criminal and wanted by the police. Stupid, but he was 8.

shareIf I remember right her suspension and curiously really kicked in high gear when Kevin pulled out the credit card. Not everyday you see a kid walks in by themselves with a credit card.
