I know this was the early days of the web (so early I'm calling it the web) so they probably didn't have the skills or thought it was possible, but rather than signing away the rights so another person could start charging to watch the video, Pam and Tommy should have created their own website and made it $1,000,000 a view. This way they could have sued to stop anybody else from posting it and nobody else would have profited from it.

People were already suspicious that Pam and Tommy had intentionally "leaked" the tape and were profiting off of it. Pam made it clear in the lawyer's office that if they got any money from the tape, it would only add fuel to the fire that this was all intentional.
