Where was Dylan?

So where was Dylan actually when his girlfriend finds him not at home when he said he was sleeping on the night of the murder? We know he didn't do it (and yes, I know it was just a red herring), so where was he actually? Why was he being weird about it?

The only answer that we have to that question is that his character was used as a RED HERRING or as a way to DIVERT ATTENTION away from other characters (the same way as the DEACON was also another RED HERRING who was used for the same purpose).

In other words, that just was a CHEAP TRICK that the writers played on us, because they also never had any other reason for letting us assume that there was a reason why DYLAN needed to hire a lawyer rather than simply tell the COPS where he was and what he was doing.
