Were some of Elle's actions actually borderline criminal?

For example, she claims to be an attorney when confronting her friend's ex. Keep in mind, that at this point, she never passed the bar. I don't know if it's like this in Massachusetts, but isn't it common that if a law student hasn't yet passed the bar, you can't argue a case in a U.S. court of law? Or you can't argue a case unless it's under very specific circumstances. But rarely without the supervision of a certified attorney and even more unusual for a first year law student like Elle.
