Casper - Consensual or Rape? - Guys Only

The last seen were casper wakes up in the middle of the night to find some booze and takes a seat on the couch besides jenny. Completely wasted, he tries to wake jenny up for sexual favours but she doesn't wake up. He then begins removing her jeans and then her underwear. He then sticks in it and starts thrusting her. In the act, jenny mutters "no" while casper calms her by saying "it's just me, casper", "it's ok, shh". 3-4min in the act, the screen turns black.

Here's what i think.

Jenny didn't want sex. Even if she knew casper, i don't think she'd agree for consensual sex. If you consider her side of the story, then SHE WAS RAPED!!

part 1: Casper, i think had feelings for jenny or maybe he cared for her well being. He knew telly's game and hence knew what had happened to jenny. This was clear when jenny arrives at steven's house in search for telly and finds casper in the bathtub. She asks him about telly whereabouts and casper tells her to forget about telly. When she insists, he tells her that he was fu@king a girl right now in the next door.

Hence, during the couch scene, he asks jenny to wake up for sex as if it'll be consensual. When he understands that she was high, he then forgets about waking her up and instead starts having sex with her while in her intoxicated state. To him, it was just plain simple sex. The word "Rape" must have never crossed in his mind.

I would like to ask the guys here. Put yourself in caspers position. What did you did according to you(ie, casper)? Do you consider differentiating "rape" and "getting sex"?

If you differentiate between "rape" and "getting sex" then you would be saying that HE DIDN'T RAPE HER.

If you consider both "getting sex" and "rape" the same thing then you would be saying HE RAPED HER.

[A] Common law – Generally speaking, sexual intercourse by a male with a female not his wife, constitutes rape if it is committed:

3.) while the female is asleep or unconscious; or
4.) under circumstances in which the female is not competent to give consent (e.g., she is drugged, mentally disabled, or underage).


-Notice the disjunctive nature of the elements.


-Long story short, he legally raped her.

NOT A GUY and it was rape.... no way if she was not high would she let him screw her knowing what she has.

Yep it was defently rape, even though both of them where under the influence there is still no excuse.

About the time this movie came out I was in the military and took a class (drug and achool awareness calls) and part of the topic was about consensual sex allso along with many other topics. The class said you have to have both verbal and physcal consent or it could be classified as rape. Though normaly if you got Physical than you pretty much got consent....as me and anouther guy said by those standards every sex we had wasn't consensual cause we never verbaly got consent....cause you don't allways just say, "Want to have sex?" and it just happens.

Since she was passed out it was defently rape. The way I saw the scene she was saying, "NO" for two reasons....the main cause she didn't want to have sex and two casue she knew she was HIV+...but was so wasted she couldn't get it through to him as he was rapeing her.

I still love this story cause it shows a real side to teens that was never realy shown before. I realy think it's funny when folks say it's a stupid movie, they apparently didn't grow up in this type of life style. I had a lot of friends dealing with these same issues in my own teens (I graduated in 94 the year before this movie came out). I just yesterday mentioned it to a friend that has a younger teen daughter.

He definitely raped her in this case because he didn't know if she wanted to have sex him or not. The only way it wouldn't be rape is if Jenny specifically said: "Casper, I want to have sex with you." The consensually must be very clear.

Tough I'm sorry for Casper. While he did deserve to be punished someway this truelly is a gruesome way to pay for this mistake.

I'm a chick & I'm answering the question - yes, it was rape. Saying, "It's okay, it's just me, Casper," didn't make it okay. She was unable to give consent & she didn't want to spread HIV to him the way that scuzzbag telly did to her.

And to whomever said men don't get HIV from sleeping with a chick w/HIV once, you are sorely mistaken. There are THOUSANDS of documented cases of men contracting HIV after a one night stand. Keep it wrapped, men!!!

Why is this even posed as a question ??? it was rape. No question about it, she was passed out and yes she did mutter "No" and he never stopped. Plus, He didn't even ask permission in the first place. Just undressed her and stuck it in which is absolutely classed as rape.
