But didn't the Hayes Code go in effect in 1934?

Some films were released without approval from whatever agency gave the Hays Code seal of approval. That meant the major theater chains wouldn't show them, but some such films played in low-budget theaters in poor areas, that weren't part of the big commercial chains and weren't included in their distribution deals.

Sorry, if I ever knew the details of this then I've forgotten them, but that's how low-budget or non-studio indie films got played. This movie sounds like one of them.
