How Kroc forced them to rename their original restaurant?


I know the brothers failed to register the trademark, but they did not display registered logo of McDonald's on top of the original restaurant.

If I were named McDonald, I'd have a full right to name my own shop "McDonald's Pizza", "McDonald's Auto Parts" or "McDonald's Art Gallery" — whatever I run.

Again — I'm not talking about the logo, golden arches etc. — just a regular name.

Am I mistaken?

If your name were McDonalds you could open any store you wanted and call it McDonalds, except a place that sold burgers. Croc owned that. That would be copyright infringement. You could call it McDowells and use the golden arcs and sell the Big Mick though.

If your name was Bob Evans you can't name your restaurant that. Only auto parts, crematorium, etc.

Well, I don't know about that... I just typed Alfredo Pizza into Google and found multiple restaurants by that name in the US and same state as well.

What and who the fuck is Alfredo pizza? That's not a franchise entity.

I don't know, that's just the first name I could think of that sounded Italian. You can try Luigi, Gian-Carlo etc and get the same results.

Anyway, why you mention franchise? If, for example, said Alfredo from Pennsylvania started giving out franchise licenses then all other Alfredo's would be forced to change their names?
