In a relationship, yes, it does. If she was a random stranger, or someone he knew but had never had sex with before, then it would be different. But if it's your spouse or significant other, then yes, there is a difference.

Actually in the eyes of the law there isn't, if you have sex without consent, ie she is asleep that is classed as rape that would count for your wife as well

I'm not sure if I want to get tangled up in some message board argument, but just in case anyone reads this and believes it I'd like to point out that legally, yes it is rape. Consent after the fact doesn't change the elements of the crime, which basically makes it statutory rape. The reason it's confusing is because if she doesn't have a problem with it then of course she's never going to file a police complaint, so of course he wouldn't be charged and no prosecutor would try and nail him on it. But if she wanted to for some reason, she could.

Depending on where you live of course. Some states in the U.S. are starting to pass "yes means yes" laws meaning that you actually have to get a verbal ok from the other person otherwise it doesn't count as consent. Those that don't have this, it's more of a gray area because if it makes it all the way to a trial it is basically going to come down to who the jury believes is telling the truth.


Basically, just don't have sex with anybody without making sure it's cool beforehand. Assuming you're in the clear for something and then later finding out you shouldn't have done it is a bad move in all areas of law. Dumb simplified example: If you eat your coworkers lunch and they were fine with it then everything's cool. If they didn't want you to it's stealing. In both cases, not asking for permission technically makes it stealing, because the intent to take it was still there and you never asked for it. Only sex is a lot more serious than lunch.

Sorry that was kinda long. I think we can all agree this season has been pretty bad compared to the earlier ones.
