the law

The law about how the police can terrigate is absolutelu crazy! That they can make things up, i cant belive it!

Poor kid, you dont do like the police did in this movie to a child. And for all sake, do videotape the interregation always, every states! Cause this reaaly shows how it can be and its totally WRONG!

It's true, and the movie tells the truth.

They couldn't really interrogate him like that, he could have left, he could have had a lawyer present to help him. Those were his rights.

But like so many others, he did not know of these rights, and the police of course aren't too eager to let him know that he can just blatantly refuse to answer.

The only real tip I can say to anyone that ends up in a situation anywhere like this one is, shut up, give your name, adress, contact info, but say nothing else, wait for a lawyer.

The whitehaired female lawyer says it in the movie, theoretically, he was not under arrest and could have just walked out of the police station at any time....

Remember, the police are not the ones that are going to convict you, that's the decided in a court, if you refuse to answer their questions, all they can hand over to a prosecuting attorney is a blank paper....
Remember the Escobedo-Miranda (sp?), "you have the right to remain silent, everything you say can, and will, be used against you in a court of law".
Those are not empty words, those are very real truths. Whatever you say to the police, they will use against you. If you say nothing, which you have the right to do, they have nothing to twist and use against you.

Thanks for your answer.
The only thing that comes up to my mind is how they can do this to a child. Yes they may read up his rights but do kids really know how tho use them? I dont think so in a age of 8 or 12 or 14 as he was. So crazy really!

Yes, that is very good advice and what we were told. Just tell them who you are but don't say anything else.

The way the guys worked in this situation was by telling him he would get out quicker if he talked. So he started talking, and they worked on him. He believed he would be helping them. It's abhorrent that there wasn't a parent present. That is the law here for interviewing minors. And of course there should have been a lawyer. I don't think children should be allowed to waive their rights unless they have a parent agreeing as well.

This disturbing movie makes me appreciate even more that I live in Norway. Here the police can't even touch you if you are under 15 (if so it's a case of other offices, not the police department), and not to mention the sickening disgusting idea of putting away 14 year olds in prison for life like they have done in some states in the "modern" USA.

Powerful acting in an emotional tv-movie. One of the things the US actually CAN DO WELL: make good tv.

it would only be right to put a kid in prison if he actually did a very serious crime, like actually killing people.

im not bossy, i just have better ideas

I think people should only be punished as adults if they have the rights of adults.

Give 14 year olds the right to vote, then I'll agree you can give them adult sentences.

Either we decide that minors are not mentally competent enough for full adult rights, in which case their resposibility for crimes is lessened, or we give them the full responsibilities *and* rights of adults.

Anything else is schizophrenic.

No, I would not want her tried as an adult. Sex has fewer and less severe consequences than murder (although it can be quite serious, of course.) I think it's completely illogical to say that someone is "not prepared for the consequences of sex" but somehow is prepared for the consequences of murder.

So saying a person is not old enough to have sex but is old enough to take full responsibility for murder just seems crazy to me. In my opinion, full responsibility for sex comes before full responsibility for more serious stuff.

creatorof2002: You might be able to seduce a 14-year-old girl if you're a savvy 28-year-old pedophile, it happens all the time. Find an insecure girl, tell her she's your woman (Taxi Driver!) or whatever the F she wants to hear and she's yours. That really isn't her fault. But when she goes to school with a loaded gun and shoots a bunch of her classmates, she's on her own, there. A school shooting (or whatever would drive a child to murder) is all about her rage, her experiences and her demons. It's not the same thing as being taken advantage of by an adult who knows exactly what he's doing.

FACT: A 28 year-old man seducing a 14 year-old girl is not pedophilia. Prove me wrong.

You guys are nuts! If a 14 year old (voting or no), commits an adult crime, what the hell is wrong with putting him in prison? Just because he's 14? If he can commit murder or armed robbery then hell yes, he should be tried as an adult. Get real. They don't deserve some wacko get out of jail free card because of their age when they go and kill someone.

Sheesh.

From what I heard, that under German law, the German police have to turn over evidence which pooves your innocence. If they failed to do so, the cops are kick off the force and get send to prison for about a year.
