It seems that Sam and Pilar are half-brother and sister. In most places, sex between people related that way is illegal. By contrast, many places do not consider sex, even marriage between a step-brother and step-sister as wrong,or illegal (good for the Bradys).
Should Sam and Pilar be arrested. They are not blind to the situation. If not, when should people be arrested?
While I'm not a fan of incest, no, I don't think they should be arrested. Regardless, insect between two adults in Texas is considered a misdemeanor sex crime so I suppose they could be prosecuted in some way.

Seriously though, I love this film, and I want Sam and Pilar to be happy. It's definitely an awkward situation for them. They'll probably feel a little weird about it for the rest of their lives, but I hope they'll be happy. That's the way things go for them in my mind.

In no state would two consenting adults be arrested for half-sibling incest that nobody besides the couple and Pilar's mother knew about. Even if everybody in the town knew (possible) no legal action would occur. They are adults and can sex any other consenting adult they like.

I remember someone asking in an interview what he thought happened later. I don't remember if it was Sayles, Cooper or McConaughy who was asked. The person said since Sam wasn't going to run for sheriff again and was tired of living in his father's shadow that he would move to a major Texas city like Houston. And that probably Pilar would follow and they would blend in with a million other people.

As Pilar's key line of dialogue alluded to, the reason incest is illegal is because inbreeding has such a high rate of birth defects.
The idea of mating with your own sibling is abhorrent to most people on a sort of instinctive level. No matter how objectively "hot" your sister/brother is, a 'normal' mentally healthy person won't be able to feel any attraction toward them. It's probably tied to evolution. Over millions of years, people who mated with unrelated strangers have had much better odds at producing healthy hearty offspring and thus promoted their own bloodlines... as opposed to inbreeders who too often produced severely effed up ree-rees who never procreated.
But one way or another you have to be aware that you're related. If two half-siblings aren't aware they're such, and there's no obvious physical resemblance staring them in the face, and so as far as they know they're unrelated, well, what's stopping them from being attracted to each other? And if they've been in love with each other for over 20 years, suddenly finding out after that long might not be enough to change their feelings.
