Question about legality?

I remember seeing this movie a long, long time ago, for forgive me if I have the scenario wrong.

At one point Goldberg and her friend are having dinner in a cafe. Two CEOs from rival companies pop in near them and have a chat. During this chat Goldberg hears something that will cause the shares to rise. Accordingly in invests in them and makes a heap of cash.

Is this considered a form of insider trading?

reply

I am not 100% sure but I would say no.. I think if Aaesop told her about the sale and the stock going up then that would definitely be insider trading.

Real love is FOREVER!!!!

reply

No, it's not insider trading by any definition of the term. She had no advance knowledge that the meeting would be taking place in the cafe, nor did she actually even know the content of the meeting (she left as soon as she realized the men Aesop was meeting were affiliated with HP). She only knew that the meeting in fact did happen, and she formed her own conclusion based on what she saw.

However, the investigation that did eventually happen was in fact plausible, because when Laurel was seen in public with Aesop, anyone could assume that they possibly knew each other prior to the stock transaction.

A scenario like that is like hitting a winning lottery ticket. Nothing wrong with or illegal about cashing it in.

reply

Why was Laurel worried about fraud when she contemplated coming clean when the OCC first approaches her with the subpoena? Because why then is she not worried about the same thing when she comes clean at the end?

reply

Trouble was she let the public know that she won that lottery and then put herself in a position to question how she did it.
