I may have missed this in the first few episodes but why is the general's wife in jail for 40 years?

HAHA, felt the same. Thought I had skipped an episode. There are several plot points that don't get explained well, or are saved for a later point. This one though, as important as it is, should have been early in the series. I'm pretty sure a general at the head of a military branch, would have some issues staying in charge with their wife committing a serious crime.

Also, why is the head of a military branch living in CO and not in DC, working out of his plush pentagon office?

Because the HQ of the new branch is in CO itself.

right, all the other chiefs of staff in the pentagon in DC, while he's cooped up in the Colorado mountains

Realistic or not it’s necessary for the show to happen. And it’s good for General Naird personally- the other chiefs of staff seem to be total jerks.

I'm not American or even a lawyer, but AFAIK isn't first-degree murder or treason the only crimes that would merit a sentence of this length?

Most likely yes. However, it’s possible that she’s doing time for MULTIPLE crimes with sentences that added up to 40. I don’t think they specified that she was only convicted of one thing.
