File the 1983 motion?

This part confused me. When Cohen was talking to Hirschkop about their case, Hirschkop told Cohen that if they tried to appeal the ruling, they could end up in prison. He then suggests that he file a 1983 motion. If this story took place in the 60s, how could they possible file the 1983 motion?
