No lawsuit for copyright infringement?

Let me make this clear for starters. I was not a fan of the original movie. I liked the books but the movie was awful.
When I watched this trailer it seems like it copied so much from the movie. I know the move itself has protected laws but isn't the screenplay itself protected?
