Does anyone else not understand the ending? (Spoilers)

I watched this late last night and maybe me being slightly tired had something to do with it, but I was a little confused...
So, Brad goes to the police and discovers who one of the guys was who beat the crap out of him about 6 months before all the hazing leading up to the death of his roommate. Then the frat gets a huge slap on the wrist, I guess (they didn't really elaborate what exactly happened to them, I don't recall; like I said, I was a little tired while watching).
Here are my questions:
1. Had it been discovered that Brad's roommate, Will had been one of the guys who assaulted him? I know the photograph they showed him revealed that he was shot outside a gas station, BUT maybe it was just me but the photo looked A LOT LIKE Will. If so, how do you explain that they show him running just a few seconds before passing out then dying?
2. What was the point of Ben not recognizing any of the men in the police line-up? And why did his brother, Brett drive him in the middle of nowhere?

Any insight?
