Attempted Murder?

After dropping the victim at the hospital and the police had figured out that he must have pulled the poor dude up from the hole by the rope visible at the hospital. The victim would not have been able to recognise him or the cab at the scene of the beating and so his regaining consciousness likely provided no new evidence other than he was dropped in a hole. If anything it would have confirmed that he wasn't the beater (victim's memory of a different body shape) Couldn't see any evidence that put him at the beating or suggested that he had not planned to recover the injured man all along leading to a lesser crime??
