Umm Innocent or Guilty?

When the judge is giving the jurors the final instructions she tells them they need to find the defendant innocent or guilty. Umm, hello? No judge would say that because you don't find a defendant innocent ever, you find them NOT GUILTY. Maybe I'm nitpicking, I don't expect a movie or show to be without flaws, but this one seems really silly and I can't believe it made it's way into the show.
