Abe's fingerprints would have been on the OJ cup

You're probably right but not every fingerprint is usable though, it could be a partial or be smudged.

Abe is also shown wiping down the outside of the cup after he puts the cyanide in it. Yes, he's seen holding it on the way to the park bench but he could be "palming" the cup to avoid getting his own fingerprints on it.

You watch too much CSI.

1. You need him as a suspect first.

2. They don't have every person's fingerprints in the database.

3. Nobody knew how the person was poisoned. How would they know that someone poisoned his juice, when and how? Where would they find the cup?

The prints has crossed my mind but I was will to be quite happy with the same two answers you listed. The third, that he would have tossed the cup and they wouldn't have looked at for it in time because they were thinking natural causes, that never crossed my mind. And that is the perfect and natural answer.

Right--so as long as Abe (and Jill) keep quiet, there's no way that innocent 'person of interest' would even be indicted by a grand jury. The cops know the bad history the innocent person had with the judge--so they know that person couldn't approach the judge on a park bench and slip him the poison. Maybe there shoulda been a scene where Abe lays out all this to Jill--so if Jill still insists on Abe turning himself in, there's be less people on Jill's side.

I disagree. If it's an election year and the DA needs a win, he could have easily convinced a jury that the innocent man was guilty. It happens a lot actually.

maybe, but the cops don't want to bring to trial a murder case with just circumstantial evidence because a jury might not convict, and the guy gets off.
Cases have not gone to trial with even more evidence to suggest guilt.
Also--I think the cops would first offer to give the innocent man a lie-detector test, which he would most likely pass.

And cases have gone to trial on a lot less. Depends on the court and area.

The police would not have his fingerprints on a database unless he had previous crimes on his record, so the prints would be useless unless he was a suspect. Anyway, it was rather stupid of him not wear gloves. Come to think of it, the whole character was bit of an idiot, really. Good acting by Phoenix, though.

It was first believed that the judge had died of a heart attack. They probably believed this for at least a few days.

By that time, the cup would be long gone, in a trash bag, picked up and forgotten. Impossible to tell which cup was his, even if they did suspect foul play.

Also as PP said, fingerprints could be there, but not much use without someone to compare them to.

You can see when he is carrying the cup in the park, as he sits down and does the swap, that he has what appears to be a piece of paper/cardboard or cloth wrapped around the inside of his hand to prevent transferring prints to the cup.

The EMT's, on seeing an older man keeled over on a park bench, might've assumed 'heart attack' and ignored the OJ cup in their haste in trying to revive him. It's not definite the EMT's picked up the OJ cup with a cloth to not damage evidence--they're not cops.

I had another problem with the OJ cup. The initial news reports said that he died of a heart attack. The autopsy revealed that he had cyanide in his system. So far so good. But then the parents of Emma Stone's character are discussing the cyanide in the OJ as if they heard it in the news. So we are expected to believe the police kept a sample of the OJ in the cup when they thought this was a case of a man of 60 having a heart attack while jogging.

They found out how he died from the autopsy. Stomach contents would have revealed what he had eaten and drank.

What we got here is... failure to communicate!


There's a couple of photo stills of Abe on the bench where the judge is sitting and there's a clear view of Abe holding a brown paper napkin around the cup. This, coupled with the fact that Abe is shown wiping down the cup beforehand would mean that his fingerprints would not be present on the cup.

Yes! This bothered me so much - he's spending so much time carefully wearing gloves, etc. and he can't be bothered to avoid printing on the damn murder "weapon"?! Sigh.

Also guys if he hasn't commited a crime before his fingerprints are NOT in the database

There isn't a magic DB with everyone's fingerprints taken the day we're born :D

So what? Finger prints or not, the movie still works. Woody Allen ranks as a one of a kind film maker who does what no one else does on a reliable consistent basis. Where else can an audience go to find entertainment with challenging intellectual content? Not Spielberg, nor Scorcese, nor Tim Burton. 90 percent of what is out there are over produced cartoons, like the Jurassic Park franchise. Anything from the Wood-man is a welcome relief, an oasis in the Gobi Desert. (BTW if you don't happen to agree with what I have just stated, please DON'T comment. Keep your negativity to yourself. I was assuming that the cyanide took effect after the judge started walking/jogging back home, hence the OJ cup would be somewhere in a dumpster where the judge must have thrown it. Was there anything in the movie to suggest that the judge died on the park bench?

Regardless, when he was found dead, people understandably assumed that he died of natural causes so no one would have bagged the poisonous OJ cup.
