How f^cking stupid were the Cahills?

Ben knows he didn't beat up the neighbor. Charlotte knows Ben didn't kill Emily, so he'd have no reason to beat up the neighbor. So why the hell were they worried about her identifying Ben as a guy who was at Emily's apartment?

If she wakes up, maybe she can identify the guy who attacked her. It doesn't matter what she says about Ben being at Emily's place, the guy who attacked her would be an instant alternative suspect trying to take out a potential witness to his crime.

Emily is his ex-girlfriend, she's the girlfriend of the guy his firm is suing, and her body was found in his house, is the neighbor seeing him in the building really going to be such damning evidence of his guilt? If Ben is the only suspect in Emily's death, then disappears, seemingly on the run, and then her neighbor winds up dead, that's only going to look worse for him.
