What does Brody mean: still illegal in 42 states?


When they sign their contract, early in the film, Brody talks about all the things he's going to do to their waiter. What does he mean, when he says "most of them are still illegal in 42 states"?

Is normal sex illegal in all those states? I mean, the waiter seems old enough and I don't think he's planning on raping the waiter or something like that. I'm not from the USA, I don't get it.

Can someone elaborate this for me?

Sodomy is illegal in many states still as is oral sex even if you are doing these acts in your own home.

Ow wow okay. And that in a country that's so keen on small government. I guess they don't enforce those laws any more?

No it is no longer illegal because in the early 2000s the Supreme Court strike down the sodomy laws throughout the country. Since that scene took place about 10 years ago maybe it was suppose to be before the cout's decision.
