I don't live in California. Can someone please explain to me why the local government isn't getting the school up and running?

It's a charter school. A charter school is building a better school than the government would and using it to shame the government into doing better regarding education. You get approval for the charter and you go ahead and get somebody to sponsor it. It's a public school but run like a private school. Typically a lottery system to get in. It's common in big cities like L.A. and NYC.
