How was Toby not caught?


I loved this movie. And I know that some stuff is left out to make movies more relatable/ happy ending. But there was quite a bit of evidence against Toby:

1. Him desperately needing money to save the farm
2. Him traveling to Oklahoma casinos several times to convert large amounts of cash to chips
3. The fact that his brother was identified as one of the bank robbers
4. He was identified by police when he was driving away from the last bank they robbed, which looking back would be suspicious
5. The exact amount of money stolen from the banks was used several days later to save a farm they knew belonged to one of the bank robbers ( Ben foster)

I know it's just a movie, but I wasn't expecting Chris pines character to get off so easily despite all the evidence against him. Didn't know everyone else's thoughts

1. The cops were never told by the banks who handles the property's trust about the dept owing. They had gotten the money and also got a trust which they don't want to loose.
2. Toby had told the cashier that he sold his car and was paid cash, he also didn't travel to the same casino.
3. The rangers looked into Toby but they found nothing, they said that tanners partner would most likely be tanners ex cell mate who fit the bill.
4. He didn't have a record not even a parking ticket, he also went the longer way around so he wasn't coming directly from the crime. The only thing i can say is if those cops were asked and showed Toby's picture, they could place him in the area.
5. Actually tanner was never involved with the bank at all, only toby handled the account. The ranch was left to toby not tanner, also howard is probably a common last name in Texas so they probably didn't put two and two together.

I understand, it still was written for him to get away with it and it can be a hard thing for people too process because people were killed and he is supposed to be the good guy.

I always remember a writer saying you always need to protect your hero, meaning they can't do anything that the audience would turn on them. Example murder etc.

Toby never killed anyone so they protect him that way, but he is the one who planned the whole thing so he is implemented in those deaths.

I look at the film more in the light of life and where it takes people. A small story that could have really happened exactly the way it's written.

There were veiled threats between the two men at the end that it's not over yet. Toby even told him where he could be found in town. Both men probably feel some responsibility for the deaths of their partners. The Ranger told Toby he would be living with the consequences for the rest of his life and he would not feel free. The same thing could be said of him as well.

The other Ranger was reluctant and kept saying his partner was hot and heavy about this crime looking for justifications to stay on the job longer.

I don't know everything. Neither does anyone else

It would most definitely stay with both men.
Marcus for not bringing Toby to justice for him the case is never over until Toby is dead or behind bars.
Toby for planning the whole thing which resulted in the deaths of innocent lives and the death of his brother. His brother may have been a murder but he is still blood and blood is thicker than water.

Who knows what will become of both men, it may turn out that marcus spends the rest of his life trying to bring toby to justice. Knowing once he does that's it for him, all he knows is the law that's his life and in a way Toby being free will most likely extend his life because he now has something to live for. That's why he went out to the ranch.

I am now convinced this is the same person posting this same subject over and over again (there are several threads asking the same questions and making the same claims ... using the same words and writing style).

Only Toby Howard, Tanner Howard, and the Midlands Bank knew that. Even if the Rangers had gotten a warrant for Toby's bank account (assuming he had one) they wouldn't have found anything because the reverse mortgage was in their mother's name, even if she did leave the ranch to Toby. In other words, the money never went into Toby's bank account. The Bank Manager applied the checks directly to the over due mortgage and tax debt owed by the mother... none of it was ever put in Toby's name/account. The Midlands Bank was insured for the 43 thousand dollars they loss. They weren't interested in giving the Rangers access to Toby's bank account because they were handling his sons' Trust.

Toby and Tanner went to a casino in Oklahoma the first time and Toby went to a casino in New Mexico the second time.

3. The fact that his brother was identified as one of the bank robbers

Many people commit crimes without the help of their kin. And the Rangers checked Toby out--they visited his ranch and looked around as much as they could without a warrant. They didn't see anything suspicious on the ranch so they asked a Judge for a warrant to check Toby's bank account. The Judge said no because there wasn't any evidence to suggest Toby had been involved in the robberies and he had never been in trouble with the law a day in his life. Whereas Tanner had spent 10-years in prison with a cellmate who was in for armed robbery. When the Judge denied the Rangers' request for a warrant the Rangers went directly to Midlands Bank to see if there was any strange activity with Toby's bank account. Midlands Bank wasn't interested in cooperating with the Rangers because they were caretakers of the Trust Toby had set up for the boys, and the monthly service fee.

4. He was identified by police when he was driving away from the last bank they robbed, which looking back would be suspicious

He was not identified by the police. All they did was check the car for obvious detail connected to the crime and Toby's demeanor and then they ran his State license number to see if any flags came up and if the person in the car matched the person on the license, just as they had the person in the car in front of Toby.

This is what--in all your posts on the subject--you just don't understand. The ranch belonged to their mother, which is how she was able to sign it over to Midlands Bank in a reverse mortgage. She left the ranch to Toby Howard in her will, not Tanner Howard, and Toby signed the ranch over to his sons in a Trust. There was no connection between the Midlands Bank and Tanner or the Howard ranch. And again ... the Rangers found no evidence of Toby Howard being involved in the robberies and the female Ranger at the end told Marcus (Jeff Bridges) that Toby Howard had been cleared and was not a suspect.

And about the "exact amount of money stolen from the banks?" Since the Rangers never got a warrant to check Toby's bank account and Midlands Bank refused to give them access without one, there was no way for the Rangers to know about the reverse mortgage on the Howard ranch.

I appreciate your response. But I just watched the movie for the first time the day I made the original post. You can easily confirm this by looking at "my" other posts on the board and seeing that others simply had the same questions about the movie. Thanks for providing more clarification

I thought the biggest plot hole is, why didn’t Marcus pursue the case after shooting Tanner? He had 3 weeks left on the force. You’d think he would be working relentlessly all that time to track down the other robber. And Toby would have been the first suspect since the guy in the diner said those two looked like brothers. Marcus should have been the one to show pictures to witnesses, visit Toby’s farm, etc. Instead he did none of that and didn’t bother with the case until quite a while after retiring.

That was part of my question with my original post. Ben foster's character killed 3 people, including 2 cops. With all the resources detectives have, it seems like there would have been a manhunt for his accomplice.

Although he was not a suspect, in real life Chris pine's character would most likely be questioned either way because he recently had been in contact with his ex-con brother.

Kinda goes back to what bottleshock34 posted earlier, there was no way they would give up the hero of the movie at the end, which is understandable.

No, no plot hole he would have been told to either begin hjs retirement nkw or take the time off which would run into his official retirement. The same would have happened to any officer who had lost their partner like that. They would be emotionally compromised in the first place.

Even if he was allowed to he would hunt toby down to the point where evidence would not be accepted by court or toby would get off for the way he was treated. Criminals have rights and toby would have most likely got off on a stupid technicality Eg. He didn't have his rights read to him. And with the lawyer he had that would be a high possibility and once cleared they can't be tired for the same crime again.

I think the Rangers likely figure it out and catch him. Especially with the high profile of the shootout and one senior Ranger on Toby's trail.

However, Toby probably would be willing to get caught if it meant saving the ranch and doing good by his family. At the end the ranch is already saved. The worst case scenario for Toby's family is they have to repay the bank for the stolen money witch they could easily do.

I think the worst case scenario would be toby being put on death row, which would be a likely case if he were caught.
