Wouldn't he go to jail after robbing his boss?

The guy robs his boss to get the money, and, as far as I recall, he lets his wife go without getting the money back. Epilogue: He ends up in jail and the kids are sent to Spain with their mother. Just saying...

His boss is a bit of a crook, don't forget. He doesn't pay tax on some of the profits that he makes and makes it clear to his boss that he knows this.
He doesn't take the money, he says he's only taking a loan and that he will be paying it back. Yes, he could go to jail for this, but so could his boss if he tells on their fishy deals. The story holds together.

Yes, the boss was a crook, so the legal system would not be involved. That, however, could be even worse for Sebastian as he receives extra-judicial justice from the boss' friends. And then the children go back to Spain.

When the kids say in the final scene that they are going to miss their mom, Sebastian tells them not to worry because they will see her soon. It's pretty obvious he's already working a plan in his mind. He'll most probably threaten his ex wife with revealing everything to the police if she doesn't return the ransom money to him. Knowing she won't be able to return from Spain to see her children if she's accused of kidnapping, she'll probably cave in to his demands. Even if she refuses to comply, Sebastian can report her to the police as the kidnapper and strike some deal with some of his friend's contacts to get the money to pay his boss back, even if he ends up heavily (and dangerously) indebted. Sebastian seems to be the resilient survivor kind. Either way it's pretty much check mate for Delia.
