Did they pay Casey to use her likeness?


Before I begin, I want to point out that I have yet to see this film.
All I've seen is the trailer with the song from Donnie Darko.
After watching that trailer, I have to wonder if they paid her.
I mean they used her name and her likeness.
Maybe I'm naive but it seems like they'd have to pay her.
It kind of bothers me if they did because I think that would kind of defeat the purpose of the film.
From watching the trailer, it comes off as a serious film about her being found not guilty for the murder of her daughter despite all evidence.
It seems like a mixed message if they'd give her money to use her likeness in a film about the injustice of her trial.
So was she paid or does this film fall under fair use or am I missing something?

Why?

The Naked Gun films did portrayals of criminals; terrorists; political leaders. Were they paid? I doubt it.

My understanding is that once there are criminal charges against you, your name and face are in the public domain, so to speak, and anyone is now allowed to comment about you, write about you, and make movies about you, without paying for the privilege or the threat of a lawsuit. Especially if they're just reporting facts.
