Small gripe about the film

I really enjoyed this film, but just have one problem. When they are at the Samanthas party for her book getting published, doesn't Samantha say she is going to go get a drink with Kate? If Kate shouldn't be drinking, wouldn't rusty have heard what Samantha said and stopped Kate from going with her to get champagne?
