How can they get away with it?

So I watched Dredd first which I really like and then I have watched The Raid with a dvd i bought recently. I also like this movie and plan to buy the sequal too. You probably know what im goint to say now, and yes i could see many resemblances between Dredd and The Raid from the very beginning which was really strange to me, so I googled about it. They say the script of Dredd was made long time ago and it was leaked before the movie was being produced, and then the director of The Raid used the leaked script for The Raid. Im not trying to argue about which movie is better or not. Im just coruios about the situation like this if what people claim is true. I mean, isnt it plagirsm? Or is it just okay to use the scrtip if the script goes public accidentally as long as its not being produced? I'm not talking about a moral issue here. It's really not worth even mentioning about it.

So if we ignore the moral aspect (I actually think it is worth mentioning), your question is about the legality. The most obvious answer is that it would be nearly impossible for a lawsuit to be won on the basis of a similar plot. How many countless movies have similar plots? If indeed Dredd's script was leaked which allowed The Raid to use the same plot, who is sued? The leaker is really the only one who violated any agreement.
The writer of The Raid simply says he used other people's ideas to produce the story. Countless stories, books and movies, pull ideas and concepts from other material.

If nobody sued anybody, then everybody is cool with it.

Both movies were awesome. I'm going to watch the Raid again.
