how is this legal?

isn't bates motel and the kind of imagery presented on the dvd cover owned by universal? this would make any normal consumer assume it's a spin-off/sequel to psycho, but it's not.

It doesn't say "Bates Motel," it says "The Bates Haunting," and the sign is in the shape of a crest, not rectangular. Although it may be misleading to consumers, neither the sign itself nor the house behind it (to the right of the sign, not the left) are identical to the imagery that's owned by Universal.

Are you really trying to nitpick a defense? The cover is OBVIOUSLY hoping to get a few sales based on people assumption that it has something to do with the Psycho franchise, especially with the success of the A&E prequel series.

Of course they are. And yes, they are being nitpicky. But, that's on purpose. Obviously lawyers have reviewed the cover and movie and agreed that there are enough differences from Psycho that any lawsuit against them would fail in court.

Well, The Bates Motel and Haunted Hayride has been an actual attraction in Pennsylvania since the 90s. Normally, I wouldn't think corporations would take the time or money to go after a local attraction, but in the time that it's been active, this attraction has become the number one haunted attraction in America. And has probably raked in a lot of dough over the years.

This movie was made around the same time Bates Motel went into production, but I think their hook has more to do with the original Psycho. They were probably just using hype from the series to generate buzz about the movie, and maybe even the attraction, too. There are definitely similarities, but if you watch the movie, they make Psycho references all over the place. Universal needs to take a closer look at this place, and start getting their cut of the take.
