Non-compete clause?


I thought it was established early on that Marty's contract included a non-compete clause? That way he wouldn't be able to work as a consultant anywhere else if he ever departed from Galweather?

So how was it he was able to just get up and start his own management consultant firm without Galweather's legal team being up his ass? Did the writers forget that this happened or did they just hope everyone would forget so that they don't have to put in the effort of explaining?

Non-compete clauses are invalid in California.

Also, I don't know about consulting but at least in finance you may have a severance package, tied up comp, and/or options which are revokable if you violate a non-compete. Generally that's how they are enforced.

The non-compete clause meant that he couldn't go to Galweather's biggest rivals, not that he couldn't ever work as a consultant again. That's why Monica said he'd be working at some crap low level job. Plus, non-compete clauses vary greatly. Him starting his own company, might have not been included...
