If they didn't pay to be in the film, how can Spurlock be contractually obligated to do anything they want - such as state the fact they did not pay to be in the film?

Spurlock said in a Q&A that he had a contract agreement with them that he could have fun with their image and do whatever he wanted with them but that they do not pay for anything. It is their company policy that they do not pay for anything. That's why they had that stipulation in the contract so others would know they didn't break their policy.

Well also the fact that just because someone doesn't pay doesn't mean they had no agreement to participate.
