She actually says right out that it's a Spider-man costume in the movie. And you can see The Amazing Spider-man written on the bag in the costume store.

shareNot the same thing This isn't a Spiderman movie nor is that kid actually Spiderman so it doesn't count and likely they got the rights from Marvel to use the imagery of Spiderman. Sony just has the movie rights for the character Peter Parker/Spiderman. This doesn't include using any imagery such as posters and costumes that aren't associated with any Spiderman movie. Since that costume is based on classic Spiderman those would be Marvel's rights and Paramount likely had to pay them to use the imagery of the costume. If the costume was based of any of The movies then Paramount would have to pay Sony. Since this isn't a Spiderman Movie and that's not Spiderman the only rights would be over usage of the costume which is far less then the cost of actual movie or character rights.

shareAny movie can use costumes of super heroes as long as the rights are acquired by Marvel. It isn't a movie off of Spider Man so there are no issue to be had with Sony. They own movie rights and not the actual likeness of him. Like when the new movie came out, Disney released the toys for the movie because they own Marvel.
The reason Spidey was not in Avengers was because Sony still owns rights for movies and no one else can make a movie with the actual character.
Disney owns Marvel which has worked with Paramount now on multiple occasions. it's not that big of a stretch.

shareIt's called "Fair Usage".Showing somebody dressed up as Spidey at a costume party comes withing fair usage, making a whole Spiderman movie does not.
There is also a certain amount of professional courtesy in the film industry. Sony does not make a fuss if Spidey is referenced in a Paramount film, and Paramount films does not get upset if someone wears a Star Trek costume in a Sony movie.

Americans are really going insane with these copywrong laws. Imagine if that caveman said "this is a fire, I just invented it. It's warm, it can cook things, and it will ward predators off. If you want to use it, you have to pay me royalties"

Recently I've learned that even MLK's "I have a dream" speech is copyrighted, I know for a fact that Groucho's face is copyrighted too. It doesn't get worse than that. There's no social benefit from copyrights, yet it seems to be the only thing americans care about. copyrights should last no more than few years, depending on what, and by whom, as in apple should not be allowed to keep anything copyrighted for more than one year, cause we all know they'll be returning the profit tenfold in as short a period of time. They once sued samsung over rounded edges o their phones. Sick bastards. Smaller things should get few more years cause they are simply not as known or well promoted.
The fact that copyrights prohibit certain materials from even being transmitted to contemporary media, means that by the time they are finally in public domain, they won't be compatible and will be effectively lost.
And no copyright should be transferable to offsprings. Kids of rich and powerful should learn how to do *beep* on their own, not how to mooch of royalties.
Also, things based on public domain materials, like disney movies, should automatically be public domain as well.
