FDA ban on gay blood: Judges can overturn?


Since when can judges overturn an FDA ban on gay blood donation? The petition should be to congress not to the courts whose roles excludes making laws. The producers of the show may wish to make a political statement but not at the expense of accuracy, especially in matters relating to the law.

They were very inaccurate when the brother made his passionate plea to give blood. He said gays are discriminated against when white males could give blood after being with prostitutes and using needles for drugs. If you have ever given blood, you know this is false. Not only are donors asked if they have ever had male-to-male sexual contact, they also ask if you have paid for sex or used illegal or street drugs by needle, even once. If you say yes to any of these, you can never donate blood. They also "discriminate" against donors if they lived in Europe from 1980 to the present (depending on the actual years and total time in country). There are many other reasons why people are not allowed to donate. Some of these reasons will defer donors from donating temporarily, while others make the deferment permanent.

It's not as if straight men never lie about their sex life. A gay man just has to mention he is gay and - boom - instant refusal, not even an obligatory blood test, and that across the board. If the brother didn't have mentioned his sexuality, the doctor wouldn't even have questioned to take his blood.

That was the whole point of the story line.

Oh, so the faggsshould keep it to themselves and its ok, but the people using needles, or having sex with prostitutes will only lie. I think all three offenses should be equally viewed as a huge risk and not given a chance...not only risky but, equally illegal.
