Deport with a minor born in US?

So, is it true that they can deport the custodial father with a minor? Should he have lied and said he had nobody in the US to take care of his son?

reply

It doesn't matter. Even in mexico if you have a son born in mexico but you are illegal adios. I don't care if I piss the pro ILLEGAL IMMIGRATION advocates. I am PRO LEGAL IMMIGRATION.

It is a myth that the US will not deport people with US born children from this country. For the longest time I thought an anchor baby was a baby born on a ship with the US flag and thus getting US citizenship. I've known mothers deported even thought they have a US citizen infant of breast-feeding age.

Are you serious?

I've known mothers deported even thought they have a US citizen infant of breast-feeding age.

And there are plenty that stay because they cry in front of the courts and make a big media firestorm about being ripped away from their children.

So are you saying that these women aren't sincere in their feelings not to be separated from their children?

They just cry to stay in the U.S., they really dont care about being there for the kids?

Ugh.... sickening.

reply

Seriously! This Yorick guy is a big lame-brain. Mexicans are people, and people have feelings and attachments like American people.

reply

They may love their kids but that doesn't mean they don't use their kids to stay here. Parents aren't always altruistic. If that offends the PRO ILLEGAL IMMIGRATIONS supporters so be it.

no they're not. they're E.T.s

stop saying that. My husband already thinks I'm an alien from some other planet.

Better to remain silent and be thought a fool than to speak out and remove all doubt.

the deported illegal alien parent can always bring her children with her back to mehico. if everything else fails, deport both mother and child, it's in the best interest of both sides--america and mexican illegals.

reply

You don't even think of them as human, do you?

reply

Of course I do. It doesn't make them any less criminals.

They split families all the time.

I don't agree with families separating no matter what. I was actually watching this movie with some relatives from another country and they said that people deported there would deport the whole family since its assumed that they would follow their primary caregiver even though they were citizens, and they would be welcome back when they are of age. I can't possibly imagine leaving my 5 year old behind if I was deported. I wonder if taking your kids is even an option in the US, since you hear about so many families being split up.

The only reason I could ever see to leave your kids behind was if you are planning to try to sneak into the country the second you get back.

reply

You guys have to think past the drama that comes with splitting families. Nobody wants to separate families...

Laws are made to control the flux of immigration.

If you didn't punish people for this then whats the point of getting a green card. You could just raise a kid. The only people who i feel bad for are the green card holders that forget to re-apply. yes its their fault but sometimes they don't understand the immigration paperwork.

Most illegal immigrants have the fear of deportation in the back of their head.

reply

they can deport a father/mother that has a american-born minor, sometimes they deport the minor as well, and sometimes they just split them and in the case they have no one they may even send them to foster homes

reply

The immigration lawyer in this movie gave horrible advice. ICE can and will deport people who have US citizen children, but the father could have at least applied for a form of relief called cancellation of removal. He probably could have bonded out of detention while waiting for his hearing(s). If I remember correctly, he would have had to show 10 years of presence in the US plus "exceptional and extremely unusual hardship" to his US citizen child if the father is deported. Since the child didn't have a mother to care for him, I thought this was at least worth trying (though "exceptional and extremely unusual hardship" is a very high standard). Asylum, which is what the immigration lawyer talked about, would have never entered the picture in this case.

reply

So it all comes down to who you have to fight for you.
It seems like there would be a lot of talk about who you should get to advocate your case when it comes to deportation.
If a person carries that fear in the back of their head, it seems they would be paying attention to what people are saying.
A prudent person would plan and make contacts.
Of course it makes a stronger movie to ignorantly take the first Lawyer in sight and trust they care and know the best way to do what needs to be done.

reply

USCIS hates to split families. That's why they prefer to deport the whole family altogether.

reply

His primary concern should be to keep the family together -- whether north or south of the border
