A defiant Buddy Valastro did not go down without a verbal fight ... during his drunk driving bust Thursday morning, he screamed, "You can't arrest me. I'm the cake boss!"

TMZ broke the story ... Buddy was arrested at 1 AM in NYC after cops say they saw him swerving in his 2014 YELLOW CORVETTE. According to the District Attorney's docs ... Buddy's blood alcohol content was .09. Of course, the legal limit is .08.

Buddy was in court Thursday as the complaint was read out loud, and it's entertaining. It says Buddy told cops he was a good guy and they should just put him in a cab ... not arrest him.

He pled not guilty to DWI and was released without bail.
