Would Alex be charged with kidnapp in the end ?

I'm confused with this part as Alex did in the end abducted the girls and give them to his aunt, so wouldn't he be implicated in the charge of kidnap at the end ?

Another thing why would he go through so much hell and not say anything to the fathers when he actually did abduct the children ?

No, he wouldn't be because he wasn't aware of what he was doing.

Because of his mental problems and because it's shown how torture is an innefective method of getting information.

Because his was mentally ill, had the mind of a ten year old and had been psychologically abused by his captors, so he would/could not "betray" them.

It was obviously his aunt's plan and he did not have the mental capacity to understand it and betray her. I don't think he would be charged with kidnapping, but he wouldnt be just turned out onto the streets to roam free. He is definitely going to some kind of asylum or hospital for a long time, maybe the rest of his life.

Alex would not have been emotionally stable enough to be charged with any crime. It would've been thrown out by a judge anyway. Hugh Jackman's character however, if found, would have been charged with kidnapping Alex.
