Game Crashing?

I had a problem with the game crashing a while back during the opening scenes when you're a kid still. Someone mentioned it was a problem with a patch the creators made.

I stopped playing out of disgust and boredom, but I'm trying to tweak out some easy Achievements - so I decided to pick this up again. Can anyone tell me if they ever fixed this, or is it still borked? The only way I can play it now is if I don't download the XBL update and play it thru my hard drive. It was a pain to get it to do this, and I'd rather not download the XBL update if its still f'ed up.
