How do the Scary/Epic/Date/Super hero movies avoid lawsuits?

I just read that Hari Puttar is off the hook legally with Warner Bros., and the movie will be released under its intended moniker. That being said, how is it that parody flicks like the Scary Movie series avoid legal entanglements when they literally take characters from original content and mock them to their heart's content?
