When Toby and his girlfriend are walking to work just before the opening credits they start talking about stale pants. Toby then remarks "well I would go commando but I don't think that's accepted in goverment". Is he making a joke about being bi-partisan or do think it's just a throwaway line?

I would assume a throwaway line - simply saying that it's not acceptable to go underpantsless in government. Not sure that underwear is a political issue, unless you're talking about Mitt Romney or John Huntsman (and I'm not saying that it SHOULD be an issue in their cases, but people keep bringing it up).
