You've beaten all of the hero missions for the Penguin chapter?
Because if you have, you should be able to get into the submarine next to Two-Face's truck in Arkham Asylum and play through the villain missions for that chapter, and unlock Bane in the first level(the docks level), and the Penguin in the last level(the arctic world level).
If you've already beaten all those levels but haven't unlocked Bane or the Penguin, I'm not sure what to tell you, might be some kind of glitch...If that's the case, try shutting off the system, turn it back on, then re-play through those levels. If that doesn't work, I don't know what to tell you...

I have tried turning it off but it still doesnt work
i might create another game and try it again

not trying to sound condescending but, are you sure youve went through 'all' 15 hero missions? you have to complete all 5 hero missions to unlock the Riddler's villian missions, all 5 hero missions to unlock the Penguin's villian missions, and all 5 hero missions to unlock the Joker's hero missions. if you have finished and beat the Penguin then you should be able to get in the submarine, and if you have finished and beat the Joker then you should be able to get in the helicoptor.
