Why does Avary get time and not Polanski?


Avary was sentenced to a year in jail for causing a car crash in Ojai that killed a woman. I am sure that Avary did not get in his car and INTENTIONALLY try to harm anyone. But, Roman did deliberately. Why does California go to great lengths to keep this screenwriter of Pulp Fiction in jail, but not bring Polanksi to justice? The US have done nothing but stall. The Swiss have for weeks been dealing with this. There needs to be some fairness in the judical sustem in California where people are treated more evenly. I am sure Avary is gifted just like Polanski. Maybe he does not have as much money to pay them and buy influence. But, that is wrong and should be changed. The judges have too much leeway for giving privilidges upon influence.Any thoughts?

Maybe because one has to pay attention to what they're doing and keep in mind the possible consequences of their actions no matter if they're driving a car or having sex with a girl. So keeping that in mind, in Polanski's case nobody died at least.

It's because Polanski fled the country to France, which will not extradite it's citizens. You can't put someone in jail if you don't have him.

It has nothing to do with the California courts, they want him extradited back to the US so they can imprison him. But they cannot go into another country or force a sovereign nation to send him back (you seem to be under the delusional impression that they can).

If Avery had fled to another country like Brasil (where his father is from) he could have claimed Brasilian citizenship. That would have prevented the US from extraditing him. He'd then be in the exact same situation as Polanski; a free man in that country, but he could not travel to a country that has a standing extradition policy with the US.
