The right to kill an intruder?



Scenarios like this are why these cases are so hard to judge. I don't think people should be allowed to kill someone who is fleeing their property, even if that person has stolen from them or hurt/killed someone inside. That is vigilanty justice and I personally think that always leads to bad things.

But how many people are able to think clearly in such a situation. It is human nature to give chase. Even the most mild mannered, law abiding person can allow fear, adrenelin, anger and instinct to take over and lead them to killing someone. It doesn't feel right to put someone in prison because they reacted badly to a situation someone else put them in.


Please consider me as an alternative to suicide

Yes and none of the people judging him were ever put in a similar situation and if they had might have done the same thing themselves, this man was NOT a real criminal.

In the southern part of my state (California) an 80 year old man did something very similar recently killing a possibly pregnant woman who had broken into his home AND beaten him up so badly he had broken bones.

Well the main character in this made the mistake of accepting a plea bargain but had he insisted on a jury the jury most likely would have nullified. Juries do that sometimes, they are ordered to follow the law and be objective but they are human beings with their own biases and ideologies. I think the jury would have nullified for this guy. They have all either had their homes burgled or have had a friend or family member that that happened to or at the very least have lived in fear of it happening and they will deep down respect and admire this guy and be glad he did it.

I am almost certain that this 80 year old man will get a jury nullification.

This kind of reminds me of that case in Minnesota. The elderly man who had his home robbed on previous occasions decided to lie in wait for it to happen again. He shot and killed a teenage girl and her boyfriend in the basement.

i see the OP's point and all but i got to side with creatorof2002 as there is no way i would convict someone in a situation like him as he was just an average/decent person who was put in a bad spot. it's not like he was some hardened criminal.

the way i see it... once someone crosses the line and is on your property trying to rob you AND they come into your home they pretty much got it coming is the way i see it. if people where killing those breaking into their homes it would send a clear message to the criminals out there to not do it otherwise you risk your life.

I thought it was strange that they arrested him at the scene. I would conduct a more thorough investigation and taken it through the Grand Jury and let them decide what to do.
