I really don't think he rationalized it but you're right, you never know what the guy is going to do, even if he's not armed. You live a life of crime, you suffer the consequences.

I don't believe for a mn that he could have spent a week in jail for killing that guy. My aunt was killed in an accident by a guy who was drunk driving and he didn't spend a day in jail. How can a guy in the heat of the moment who was not trying to kill anyone go to jail for killing a known felon? please.

True, but he was reaching for his belt like he had a gun. Clearly(in hindsight) it was a bluff, but one he should not have made. If it was a cop, they would have killed him too. They also wouldn't have stopped with a knock on the head. It would have been bullets, and many of them, aimed with the INTENT to kill.

Worst case scenario for a cop in his situation; Paid leave followed by being stripped of his badge and busted down to civilian status. NOTHING compared to what the average citizen faces for the same exact act, and lets be honest, the cop would get off. He'd place a drop weapon or write up a bogus report and get off scott free(99.99% of the time).

He wasn't trying to kill him. He was pumped full of adrenaline and afraid for his and his family's safety, and for all he knew the guy was reaching for a weapon.

If he's in your house and threatening your safety, his life is void. That's the way I see it.

I agree fully, what I can't accept is prison for a homeowner who was scared out of it wits by this burgular. We should have the right to protect our castle and here in Texas we do thank god.

The thing that really got me was that the robber was still on the property. It's *beep* that he would be charged with murder, it happened like 5 steps outside the front door. If something like this really happened it would be a case heard throughout the country and people would question laws concerning self defense and protection of property.

I missed the first 8 minutes of the movie. I came in when Dorff's char was walking in with the blue uniform at the county jail. So, I don't know really know what happened. In the flashback later on, it appears that he CHASED the burglar out of the house and beat that man with a baseball bat. Now, I'm no lawyer, but if you have to chase down your attacker, that's not self-defense.

@killerbee86 this has happened a lot in the US actually, with (not too) surprisingly different results for the men who were in their homes trying to defend themselves. And yes, there were people who complained, but I don't know if any change came about as a result.

I regularly read stories where the police say someone was grabbing for something and shoot the guy an insane amount of times. Later they find no weapon. Guess what! The cops aren't ever charged with a crime.

I would give some citizen the benefit of the doubt before I would some guy working for our out of control government.

Dude he wasn't trying to kill him. His adrenaline was pumping and all he wanted to do was stop the guy and seek answers on why broke into his house. He couldn't have predicted that one swing with the baseball bat and the guy would be dead. Accidents happen and an innocent man shouldn't have to go to jail for that.

This just shows how broken our justice system is. Prison was meant to rehabilitate criminals but instead it turns innocent people into hardened criminals.

Thank god the law disagrees with you you're not allowed to go chasing people down and killing them once there outside your house unless they pull a weapon on you then you have no right to self defense as your life isn't in danger when there running away from you it doesn't take a genius to know right off the bat that if someones running from you and you only have a bat they prob don't have a weapon or they would have used it on you instead of running.

Why give some1 who's committing a crime like that the benifit of the doubt? and What if he DID have a gun but was afraid to use it and was going to instead wait til he got to the end of the driveway to pop off shots at the house in anger? You can say what if all day long but the question remains: Whose life is more important in that situation? Yours or his. The what if's reign equal for both sides and as long as he is in your personal space withing striking range you must assume the what if's are against you that's just basic survival.

No criminal in the history of man has ran away instead of using a gun expecally when being chased by a guy who's only armed with a BAT all he would have to do is turn around and the guy with the bat would *beep* his pants and run away there for the criminal would have no reason to run let me ask you something would you run away from someone who only had a bat if you had a gun????

I live in Texas, and if this happened to me I would be confident that a jury here would not convict me of any crime.

It's actually absurd that a person could be convicted. I understand that the best course of action would be to call 9-1-1 as soon as the burglar fled from the house, but consider that it's late at night, your adrenaline is flowing, and you're scared. Plus, the criminal is still on your propery. To claim that's murder or even manslaughter is a joke.

To the people who think it's justified, if you have a family and someone breaks into your home I am guessing you will change your tune.

Yup, this is why I'm moving to Texas ASAP. The rights to defend myself and my family including the right to carry and conceal firearms. Though their efforts are valued and admirable, the police can't be there 24/7.
